RIGHT OF WITHDRAWAL

The consumer has the right to withdraw from the sales contract without any penalty and without having to specify the reason within 14 days, using the following withdrawal form, provided in Annex I, Part B of Legislative Decree 206/2005.

or by submitting any other explicit declaration of your decision to withdraw from the contract to be sent, in accordance with the law, to the EFFE 23 headquarters (as specified above). This declaration must contain the customer's bank details for the refund to be issued if payment was made by bank transfer.

1. The withdrawal period expires fourteen days after the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the goods or, in the case of multiple goods ordered by the consumer in a single order and delivered separately, from the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the last good; or finally, in the case of delivery of a good consisting of multiple lots or pieces, from the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the last lot or piece;

2. The withdrawal notice can also be sent by telegram, email, and fax and is considered to be sent within the specified time if it is delivered to the accepting post office within the aforementioned deadline.

3. The right of withdrawal is excluded for the supply of goods made to measure or clearly personalized (Article 59/c Legislative Decree 206/2005);

4. In the event of withdrawal from this contract, all payments made by the consumer to EFFE23, excluding delivery costs, will be refunded without undue delay and in any case no later than 14 days from the day on which EFFE23 was informed of the decision to withdraw from this contract, provided that the purchased goods have already been returned intact. These refunds will be made using the same means of payment used by the consumer for the initial transaction.

5. The buyer must return the purchased product, bearing the shipping costs, and the refund will be suspended until the goods are received or until the consumer has demonstrated that they have returned them.

6. Following the receipt of the intact good, EFFE23 will refund the buyer the price of the product, unless it is forced to incur expenses attributable to the buyer, in which case it will be authorized to withhold all or part of the price of the good as compensation for damages.

7. The integrity of the good to be returned is an essential condition for exercising the right of withdrawal.

8. The shipment, until the confirmation of receipt in our warehouse, is under the full responsibility of the customer; in case of damage to the good during transport, EFFE23 will inform the customer of the incident (within 5 working days from the receipt of the good in its warehouses), to allow them to promptly file a complaint against the courier they chose and obtain a refund of the value of the good (if insured); in this event, the product will be made available to the customer for its return, simultaneously canceling the withdrawal request.

9. If the right of withdrawal is not exercised in the prescribed manner, it is specified that orders placed by the buyer are binding, and in the event of goods already shipped and refused by the assigned courier or non-delivery due to direct responsibility of the customer, an invoice or receipt/fiscal receipt will be issued for the entire shipping cost as well as the cost of return to the sender, which will be charged to the Consumer.

10. In the event that the withdrawal provided for by law does not occur in the indicated ways, the provisions of Article 1453 et seq. of the Civil Code will apply, which entail the obligation for the buyer to pay the agreed price for the good supplied, without prejudice to the right to terminate the contract, in addition to compensation for damages suffered by EFFE23 in any case.

11. EFFE23 reserves the right to refuse unauthorized returns or returns that do not comply with all established conditions.

12. Special conditions:

  • For personalized and/or engraved items, returns are accepted only for size exchanges. 
  • No refunds or article exchanges are provided. For items with tiered pricing, the difference will not be refunded in case of a size change with a lower price, while the difference will be requested for a size change with a higher price.
  • After the first size change, returns with refunds or article exchanges are not accepted.


SIZE EXCHANGE

1. The first size exchange is free; only shipping costs will be borne by the buyer. With the first order, EFFE23 sends the Multisizer strip, which can be used to identify the correct finger size. Subsequently, any adjustments, where possible, will be at the buyer's expense after EFFE23 has communicated the cost of the intervention.
